Professional violinist Brian King Joseph has filed a lawsuit in Los Angeles accusing Will Smith and his management company of sexual harassment, retaliation, and wrongful termination. The legal filing centers on alleged incidents that Joseph says occurred during Smith’s Based on a True Story: 2025 global tour, describing experiences he claims were deeply distressing and professionally damaging.

The lawsuit, filed on December 30, 2025, in the Superior Court of California, names Smith and his company, Treyball Studios Management, Inc., as defendants. According to the complaint, Joseph’s professional relationship with Smith began in late 2024 after a performance at a San Diego show, where he was subsequently invited to join the global tour and contribute to the recording of new music.

The Suit and the Allegations

At the center of the lawsuit is an incident Joseph alleges took place during the tour’s March 2025 stop in Las Vegas. According to the complaint, after rehearsals and a long day of travel, Joseph returned to his hotel room—booked by Smith’s team—to find signs that someone had entered without his consent. He claims there were no indications of forced entry and that only hotel staff and tour management had access to the room.

Joseph alleges that inside the room, he found a handwritten note addressed to him reading: “Brian, I’ll be back no later [sic] 5:30, just us,” accompanied by a heart and signed “Stone F.” The complaint further states that the room contained several items that did not belong to him, including wipes, a beer bottle, a red backpack, hospital discharge paperwork, and a bottle of HIV medication bearing another person’s name.

Joseph says he interpreted the note and the presence of these items as a threat of sexual violence or unwanted sexual contact. In response, he reported the incident to hotel security, contacted local law enforcement through a non-emergency line, and notified members of Smith’s tour management.

What followed, Joseph alleges, is central to his claims. Rather than launching an investigation, a representative for the tour allegedly suggested he had fabricated the incident and accused him of lying. Within days, Joseph says he was removed from the tour and replaced by another violinist. The lawsuit characterizes this termination as retaliatory, directly tied to his reporting of a safety concern.

Grooming, Predatory Behavior, and Termination Claims

Beyond the hotel incident, the complaint alleges a broader pattern of inappropriate conduct. Joseph claims that Smith engaged in behavior he perceived as grooming, asserting that Smith was “deliberately grooming and priming Mr. Joseph for further sexual exploitation” as their professional relationship developed.

According to the lawsuit, Smith made comments referencing a “special connection” between them, which Joseph describes as part of a pattern that preceded the alleged harassment. These interactions, the complaint argues, contributed to an environment in which boundaries were blurred and power dynamics exploited.

Joseph is seeking damages for emotional distress, reputational harm, lost income, and ongoing psychological effects, including post-traumatic stress disorder. He further alleges that his termination violated California employment protections, whistleblower laws, and anti-harassment statutes.

As of publication, neither Will Smith nor representatives for Treyball Studios Management have issued a public statement responding to the lawsuit. In cases of this magnitude, silence or limited comment is not uncommon, particularly in the early stages of litigation, when public statements can carry legal consequences.

Notably, these allegations come amid heightened legal scrutiny surrounding the Smith family. Earlier in December, a separate lawsuit was filed against Jada Pinkett Smith by a former associate, marking a particularly contentious legal period.
